Condizioni Generali di Dimensione Europa GmbH

Per tutte le richieste e prenotazioni con Dimensione Europa GmbH sono valide esclusivamente le seguenti condizioni (ed esse perdono singolarmente la loro validità soltanto se è stato concordato qualcosa di diverso per iscritto):

1. Prenotazione e conclusione del contratto.
La prenotazione da parte del cliente può essere effettuata a voce, per iscritto o per telefono ed è in ogni caso impegnativa. Il contratto è valido soltanto dopo l’accettazione e la conferma scritta da parte di Dimensione Europa GmbH.

2. Tariffe, tasse e Voucher
Tutti i prezzi menzionati nei flyer e nel sito internet di Dimensione Europa GmbH sono indicativi “a partire da„ e validi solo per gruppi. Nel caso di una richiesta specifica Dimensione Europa GmbH trasmette un’offerta nella quale si precisa il prezzo. Dimensione Europa GmbH si riserva il diritto di aumentare il prezzo fissato nell’offerta – p.e. nel caso di un aumento dei costi di trasporto o indicazioni di servizi diversi, oppure variazioni di tasse, imposte, cambio valute, ecc. I Voucher vengono emessi da Dimensione Europa GmbH oppure – per accordi – anche da parte del cliente. Un’emissione da parte del cliente deve essere esplicitamente autorizzata da Dimensione Europa GmbH nel contratto, oppure su successiva autorizzazione scritta. In tal caso i Voucher del cliente sono da inviare in copia almeno 7 giorni prima dell’inizio del viaggio a Dimensione Europa GmbH. Sul Voucher dev’essere riportato ben leggibile: “booked & payable by Dimensione Europa GmbH„.

3. Condizioni di pagamento
Tutte saranno specificate nell’offerta e/o nel relativo contratto di prenotazione (generalmente corrispondono a: acconto del 50% della somma totale 35 giorni prima dell’inizio del viaggio; saldo finale non meno di 5 giorni lavorativi ante inizio viaggio). In caso di fiere, eventi speciali, progetti di una certa entità, ecc. può essere anticipato il termine e la misura del pagamento. Il pagamento è considerato tale solamente quando certificato dalle nostre banche. Se il pagamento non avviene nel termine fissato, il cliente è automaticamente in ritardo con i suoi obblighi di pagamento. Un ulteriore sollecito da parte di Dimensione Europa GmbH non è necessario e il cliente se ne assume tutte le conseguenze del caso. Tutti i pagamenti sono da inviare senza spese per Dimensione Europa GmbH. Se fossero state concordate delle condizioni di pagamento particolari per accordo scritto o orale, queste rimangono invariate solo se: a) il rating/solvibilità dell’agenzia non peggiora (base: rating secondo “BASILEA II/III„ o sim. al momento dell’accordo) e/oppure b) se i pagamenti di continuo vengono saldati in tempo. In caso di peggioramento del rating/solvibilità dell’agenzia (anche insignificante) e/oppure se i pagamenti non vengono saldati nel termine stabilito, entrano in vigore automaticamente e subito le condizioni elencate sotto punto 3 parte prima, anche per le pratiche in corso.

4. Partecipanti al viaggio e numero minimo
Generalmente Dimensione Europa GmbH concede ai gruppi una gratuità per ogni 20 pax paganti per intero. In alcuni paesi viene concessa una gratuità per ogni 25 pax paganti per intero. Al massimo però vengono date 2 gratuità a gruppo chiuso. Accordi diversi possono essere stabiliti dalle parti nel contratto o successiva integrazione scritta. I prezzi indicativi menzionati sotto il punto 2 per alberghi e altri servizi, e i prezzi menzionati nel sito internet, sono validi per principio soltanto per gruppi di minimo 15 persone, e per gli itinerari é valido il minimo di partecipanti menzionato con il rispettivo tour. Nell’offerta, da parte di Dimensione Europa GmbH viene fissato il minimo di partecipanti valido per il relativo viaggio. In caso di meno persone, Dimensione Europa GmbH si riserva il diritto di correggere il prezzo nella misura dei costi che essa deve sopportare in più. Ulteriormente Dimensione Europa GmbH si riserva il diritto di ritirarsi dal contratto oppure di cancellare il viaggio in caso di necessità se il minimo di partecipanti non viene raggiunto. Dimensione Europa GmbH informerà immediatamente il cliente nel caso di ritiro dal contratto. Nel caso di un necessario ritiro dal contratto Dimensione Europa GmbH ha il diritto di chiedere un risarcimento dei danni nelle stesse misure e nello stesso modo fissato nelle condizioni per una cancellazione (punto 7).

5. Cambiamento di servizi
Dimensione Europa GmbH si riserva il diritto di cambiare i singoli servizi oppure cambiare il programma concordato nel contratto, se questo diventa necessario e se viene data un’alternativa equivalente oppure superiore.

6. Responsabilità di Dimensione Europa GmbH – Doveri di collaborazione del cliente
In caso d’imprevedibili inconvenienti sui servizi per il cliente, l’agenzia di viaggio, l’operatore turistico, il suo autista, il capo-gruppo, l’accompagnatore oppure il cliente individuale stesso, per via del proprio dovere di cooperazione, devono darne pronta informazione a Dimensione Europa GmbH o alla rappresentanza della stessa in loco, già durante il viaggio (usando il numero telefonico di emergenza fornito ante inizio viaggio), in modo che Dimensione Europa GmbH possa intervenire adeguatamente e al più presto per migliorare il disservizio annunciato. Eventuali pretese per servizi non goduti come da contratto devono pervenire in forma scritta a Dimensione Europa GmbH entro e non oltre 10 giorni dal termine del viaggio definito nel contratto. Dopo la scadenza di questo termine il cliente ha solo il diritto di pretendere un rimborso se non gli è stato possibile ritornare senza averne colpa. Nel caso che il cliente non informi Dimensione Europa GmbH o la rappresentanza, già durante il viaggio, degli inconvenienti verificatisi perde il suo diritto di rimborso per i servizi non goduti, o quello di riduzione del prezzo.

7. Ritiro dal contratto
7.1. Ritiro da parte del cliente
Se da parte del cliente avviene un ritiro dalla prenotazione, possono essere applicate le seguenti spese di cancellazione (quando non diversamente pattuite):
cancellazione entro 35 giorni prima dell’arrivo: gratuito
cancellazione tra 35 e 30 giorni prima dell’arrivo: 25 % della tariffa totale
cancellazione tra 29 e 22 giorni prima dell’arrivo: 50 % della tariffa totale
cancellazione tra 21 e 15 giorni prima dell’arrivo: 75 % della tariffa totale
cancellazione tra 14 e 8 giorni prima dell’arrivo: 80 % della tariffa totale
cancellazione entro 7 giorni prima dell’arrivo: 100 % della tariffa totale.
Le condizioni di cui sopra possono variare in casi particolari come fiere, feste, congressi, … e saranno specificate per iscritto. In caso che norme e/o usanze nazionali (dove si svolge il viaggio) - sia per quanto riguarda il termine dell’ultima cancellazione come anche la percentuale dello storno - siano più restrittive delle sopracitate condizioni, esse veranno applicate.

7.2. Recessione da parte di Dimensione Europa GmbH
Dimensione Europa GmbH ha il diritto di recedere il contratto:
a) se il minimo dei partecipanti concordato non viene raggiunto (vedi punto 4);
b) se il cliente non rispetta i termini di pagamento concordati, oppure non rispetta i termini contrattuali stabiliti. Dimensione Europa GmbH concede un termine di tre giorni per dimostrare l’avvenuto pagamento (vedi punto 3); trascorso inutilmente tale termine, Dimensione Europa GmbH si ritira dal contratto, e ha diritto di chiedere un risarcimento danni nelle stesse misure e nello stesso modo come fissato nelle condizioni per la cancellazione (punto 7.1);
c) senza osservare alcun termine in caso di: scioperi, conflitti, disordini, catastrofi, epidemie, disposizioni di sovranità o gravi turbolenze politico-sociali, e in qualsiasi altro caso di forza maggiore;
d) e nei casi che norme e/o usanze nazionali permettano al fornitore del servizio di ritirarsi dal contratto stabilito Dimensione Europa GmbH.
In tutti i casi di recesso Dimensione Europa GmbH non è obbligata a sopportare danni ulteriori o a porre in atto ulteriori prestazioni.

8. Esclusione della responsabilità da parte di Dimensione Europa GmbH
8.1. Esclusione Generale della responsabilità
Dimensione Europa GmbH non è responsabile dei danni che non siano comprovatamente da essa causati, né per quelli che dipendono da cause di forza maggiore.

8.2 Esclusione della responsabilità in caso d’insolvenza/fallimento di un fornitore
Nel caso che un fornitore (albergo, ristorante, ecc.), il cui gestore o proprietario, cioè la parte contraente di Dimensione Europa GmbH, fosse costretta a chiudere la sua attività per problemi finanziari oppure non sarà più in grado di ospitare i clienti prenotati alle condizioni concordate inizialmente - nella sua struttura o in una struttura similare – logicamente Dimensione Europa GmbH fará il possibile per ottenere un’alternativa similare o equivalente, compatibilmente con le disponibilità sul mercato. Se il tutto è esperito negativamente, Dimensione Europa GmbH non assume nessuna responsabilità per eventuali richieste d’indennizzo in questo contesto.

9. Foro competente
Per tutti i rapporti contrattuali è valida la legge dello stato della sede di Dimensione Europa GmbH, controfirmatario del contratto. La sede legale, il luogo degli adempimenti formali e fiscali è la stessa della sede di cui sopra. Il foro competente per ogni controversia è il tribunale territorialmente responsabile per la sede di Dimensione Europa GmbH.

10. Non validità di una clausola
La mancata validità di una clausola non influisce sulla validità delle altre.

Allgemeine Geschäftsbedigungen

DIMENSIONE EUROPA GMBH

Für alle bei Dimensione Europa GmbH getätigten Anfragen und Buchungen gelten ausschließlich nachstehende Geschäftsbedingungen. Einzelne Bestimmungen dieser AGB verlieren nur dann ihre Gültigkeit, wenn von den Parteien schriftlich etwas anderes vereinbart wird.

Die Reservierung kann von Seiten des Kunden mündlich, schriftlich oder fernmündlich erfolgen und gilt in jedem Fall als verbindlich. Der Vertrag kommt erst mit der schriftlichen Bestätigung und Annahme der Reservierung durch Dimensione Europa GmbH zustande.

Preise, Gebühren und Voucher

Alle im Katalog und auf der Homepage veröffentlichten Preise sind "Kategorie-Richtpreise", das heißt, in der jeweiligen Kategorie verfügt Dimensione Europa GmbH, je nach freier Kapazität, über ein oder mehrere Hotels mit den genannten "ab-Preisen". Dabei ist nicht zwingend, dass es sich um von Dimensione Europa GmbH auf der Homepage oder im Katalog veröffentlichte Hotels handelt. Auf eine konkrete Anfrage des Kunden hin unterbreitet Dimensione Europa GmbH diesem ein konkretes Angebot, in dem die Preise präzisiert werden.

Dimensione Europa GmbH behält sich vor, die im Angebot präzisierten Preise im Falle der Erhöhung von z.B. Beförderungskosten oder der Abgaben für bestimmte Leistungen, wie Kurtaxe, Steuern, oder einer Änderung der für die betreffende Reise geltenden Wechselkurse in dem Umfang zu ändern, wie sich die Erhöhung pro Person auf den Reisepreis auswirkt, sofern zwischen Vertragsschluss und dem vereinbarten Reisetermin mehr als sechs Wochen liegen. Bei Buchungen von Einzelreisenden (FIT's) wird eine Bearbeitungsgebühr je nach Aufwand erhoben, mindestens jedoch EURO 40,00 je Buchung.

Die Voucher (Reisegutscheine) werden entweder von Dimensione Europa GmbH oder im Ausnahmefall vom Kunden direkt ausgestellt. Eine Erstellung der Voucher durch den Kunden muss Dimensione Europa GmbH im Vertrag ausdrücklich oder nachträglich schriftlich zugestimmt haben. Für diesen Fall sind die Kundenvoucher mindestens sieben Tage vor Reiseantritt an Dimensione Europa GmbH in Kopie (per Fax) zu übermitteln. Auf den Kundenvouchern ist deutlich lesbar (zu vermerken: „booked & payable via Dimension Europa GmbH").

Zahlungskonditionen

Um die Erbringung der Leistungen zu garantieren, ist die Einhaltung folgender Zahlungskonditionen – sofern nichts anderes vereinbart wurde - unbedingt zu gewährleisten:

Bis 35 Tage vor Anreise ist eine Anzahlung von insgesamt 50% des Gesamtreisepreises fällig. Die Restzahlung muss bis 5 Tage vor Anreise auf das Konto von Dimensione Europa GmbH eingehen. Im Bedarfsfall (z.B. bei Messen, Großveranstaltungen, Großprojekten, Serienbuchungen, Events bzw. Firmenevents, Kongresse, Festivals, Incentive) kann ein früherer Termin der Zahlung gelten. Der vorgezogene Termin wird im Vertrag festgehalten.

Erfolgt die Zahlung nicht zum Termin der Fälligkeit, kommt der Kunde zum gleichen Termin mit seiner Zahlungspflicht in Verzug. Einer zusätzlichen Mahnung durch Dimensione Europa GmbH bedarf es diesbezüglich nicht.

Schriftliche Nachweise für die Anweisung der Zahlung werden nur dann anerkannt, wenn sie direkt von der Bank des zahlungspflichtigen Kunden ausgestellt und übersandt werden.

Sämtliche Zahlungen sind spesenfrei für Dimensione Europa GmbH als Empfänger zu veranlassen.

Für den Fall, daß bei langjähriger Partnerschaft für den Kunden günstigere Zahlungskonditionen durch mündliche oder schriftliche Vereinbarung gewährt worden sind, haben diese ausschließlich nur solange Gültigkeit, solange sich a) die Bonität (Basis: Ranking Basel II o.Ä.) zum Zeitpunkt der Vereinbarung des Kunden nicht verschlechtert und/oder b) Zahlungen anhaltend fristgerecht geleistet werden. Bei Bonitätsverschlechterung (auch gering) und/oder wiederholt nicht fristgerecht beglichener Zahlungen treten automatisch und sofort wieder die unter Ziffer 3. genannten Konditionen in Kraft, auch wenn dies laufende Geschäftsvorfälle betrifft.

Freiplatzregelung, Reiseteilnehmer und Mindestteilnehmerzahl

Dimensione Europa GmbH gewährt Reisegruppen bei je 20 voll

zahlenden Gästen einen Freiplatz für den Fahrer und/oder Reiseleiter. Bei Reisen nach Italien, Großbritannien und Skandinavien wird ein Freiplatz für je 25 voll zahlende Gäste gewährt. Die maximal gewährte Freiplatzanzahl beschränkt sich auf zwei Freiplätze pro geschlossene Reisegruppe. Vertraglich kann abweichendes durch die Parteien geregelt werden. (keine Freiplatzregelung bei Messen, Großveranstaltungen, Großprojekten, Serienbuchungen, Events bzw. Firmenevents, Kongresse, Festivals, Incentive)

Die unter Ziffer 2 genannten "Kategorie-Richtpreise" für Hotel- und Nebenleistungen, die im Katalog und auf den Seiten „Hotelguide“ auf der Homepage aufgeführt sind, sind grundsätzlich bei Gruppen ab einer Größe von 15 Personen gültig. Für die auf den Seiten „Touren“ aufgeführten Rundreisen gilt die angegebene Mindestteilnehmerzahl der jeweiligen Tour. Bei Angebotserstellung durch Dimensione Europa GmbH wird die für die konkrete Reise gültige Mindestteilnehmerzahl im Angebot genannt. Sollte die jeweilige Mindestteilnehmerzahl unterschritten werden, behält sich Dimensione Europa GmbH das Recht einer Preiskorrektur vor. Diese berechnet sich nach den Mehrkosten pro Person, die durch das Nichterreichen der Mindesteilnehmerzahl für Dimensione Europa GmbH entstehen.

Daneben behält sich Dimensione Europa GmbH das Recht vor, bei Nichterreichen der Mindestteilnehmerzahl den Vertrag zu kündigen bzw. vom Vertrag zurückzutreten, soweit dies notwendig ist.

Dimensione Europa GmbH wird im Rücktrittsfall den Kunden unverzüglich vom Rücktritt in Kenntnis setzen. Im Falle eines nötigen Rücktritts vom Vertrag ist Dimensione Europa GmbH berechtigt, Schadensersatz in derselben Höhe und nach dem gleichen Modus zu verlangen, die unter den Stornierungskonditionen (Ziffer 7) festgelegt sind.

Änderungen der Leistungen

Dimensione Europa GmbH behält sich das Recht vor, bei einzelnen Leistungen vom vereinbarten Inhalt des Vertrages abzuweichen oder das Programm zu ändern, wenn die Änderung nach Vertragsschluss notwendig wurde und eine Änderung der Leistungen oder des Programms in adäquate oder höherwertige Kategorien vorgenommen wird.

Leistungsstörung - Mitwirkungspflicht des Kunden

Sollte es wider Erwarten zum Auftreten von Leistungsstörungen kommen, ist der Kunde, d.h. der Reiseveranstalter, sein Busfahrer, Reise- oder Gruppenleiter bzw. der Einzelreisende aufgrund seiner Mitwirkungspflicht verpflichtet, seine Beanstandungen unverzüglich noch während des Aufenthaltes am Reiseort an Dimensione Europa GmbH oder die Vertretung vor Ort weiterzugeben.

Unterlässt es der Kunde, unverzüglich noch während der Reise Leistungsstörungen Dimensione Europa GmbH bzw. der Vertretung vor Ort zur Kenntnis zu bringen, so tritt ein Anspruch des Kunden wegen nicht vertragsgemäßer Erbringung der Leistungen, insbesondere Minderung, nicht ein.

Seine Ansprüche wegen nicht vertragsgemäßer Erbringung der Reiseleistungen hat der Kunde nach der vertraglich vorgesehenen Beendigung der Reise gegenüber Dimensione Europa GmbH schriftlich innerhalb von 10 Tagen geltend zu machen.

Rücktritt vom Vertrag

7.1. Rücktritt durch den Kunden

Erfolgt der Rücktritt des Kunden aus einer getätigten Buchung, so können (je nach im Vertrag vereinbartem, letztmöglichen, kostenfreien Stornierungstermin) folgende Stornierungsgebühren bzw. Bearbeitungsgebühren erhoben werden, sofern nichts anderes vereinbart wurde:

a) Bei Stornierung bis 35 Tage vor Reisebeginn: kostenfrei

b) Bei Stornierungen mit Release innerhalb von 35-30 Tagen vor Reisebeginn: 25% des vollen Reisepreises.

c) Bei Stornierung mit Release innerhalb von 29-22 Tagen vor Reisebeginn: 50% des vollen Reisepreises.

d) Bei Stornierung innerhalb von 21-15 Tagen vor Reisebeginn: 75% des vollen Reisepreises.

e) Bei Stornierung innerhalb von 14-8 Tagen vor Reisebeginn: 80% des vollen Reisepreises.

f) Bei Stornierung innerhalb von 7 Tagen vor Reisebeginn bis Reisebeginn: 100% des jeweiligen Reisepreises.

Von diesen Stornierungsgebühren kann bei besonderen Anlässen (z.B. bei Messen, Großveranstaltungen, Großprojekten, Serienbuchungen, Events bzw. Firmenevents, Kongresse, Festivals, Incentive) abgewichen werden und ein früherer Zeitpunkt der letztmöglichen kostenlosen Stornierung festgesetzt werden. Diese Festsetzung hat im Vertrag zwischen den Parteien zu erfolgen.

Die im Falle des Rücktritts eines Einzelreisenden an Dimensione Europa GmbH zu erstattenden Aufwendungen richten sich in ihrer Höhe jeweils nach der vom Leistungsträger (Hotel, Restaurant, ...) verlangten Gebühr zuzüglich der Bearbeitungsgebühr in Höhe von EURO 40,00 und den Dimensione Europa GmbH selbst durch den Rücktritt entstandenen Aufwendungen.

7.2. Rücktritt durch Dimensione Europa GmbH

Dimensione Europa GmbH hat das Recht vom Vertrag zurückzutreten,

a) wenn die vorher vereinbarte Mindestteilnehmerzahl (vgl. Ziffer 4) nicht erreicht wird;

b) wenn der Vertragspartner seinen Zahlungsverpflichtungen innerhalb der bestehenden Geschäftsbeziehung nicht fristgerecht nachkommt bzw. die diesbezüglich vereinbarten Vertragsbedingungen nicht einhält (Dimensione Europa GmbH gewährt eine nochmalige Nachfrist zum Nachweis der Zahlung im Sinn von Ziff. 3 von max. 3 Tagen). Tritt Dimensione Europa GmbH in diesem Fall vom Vertrag zurück, ist es berechtigt, Schadensersatz in derselben Höhe und demselben Modus wie unter Ziffer 7.1 (Stornierungsgebühren), zu verlangen.

c) sofern nichts anderes vereinbart wurde, bis 3 Monate vor Reiseantritt im Falle, dass der Beherbergungsbetrieb (Vertragspartner von Dimensione Europa GmbH) von einem Rücktrittsrecht Gebrauch macht (Bsp.: gesetzliche AGB-Richtlinien für Beherbergungsbetriebe in Österreich, AGBH).

d) sofern ein Rücktrittsrecht des Kunden innerhalb einer bestimmten Frist schriftlich vereinbart wurde, ist das Hotel und in Folge Dimensione Europa GmbH in diesem Zeitraum seinerseits berechtigt, vom Vertrag zurückzutreten, wenn Anfragen Dritter nach den vom Kunden gebuchten Zimmern vorliegen und der Kunde auf Rückfrage unter Mitteilung eines derartigen Sachverhalts auf ein ihm eingeräumtes Rücktrittsrecht nicht verzichtet. (Bsp. IHA & DEHOGA AGB-Empfehlung für die Hotellerie in Deutschland).
e) ohne Einhaltung einer Frist bei allen Fällen von höherer Gewalt, Streiks, Unruhen, Naturkatastrophen, Epidemien, hoheitliche Anordnungen oder grundlegender politischer Veränderungen; Dimensione Europa GmbH haftet in diesen Fällen nicht für dem Kunden entstehende Schäden und Kosten.

Für alle Fälle des Rücktritts durch Dimensione Europa GmbH ist Dimensione Europa GmbH nicht verpflichtet Schadenersatz zu leisten oder Leistungsersatz zu stellen.

Haftungsausschluss

8.1 Allgemeiner Haftungsausschluss

Dimensione Europa GmbH übernimmt keine Haftung für Leistungsstörungen, welche nicht nachweislich durch das Verschulden von Dimensione Europa GmbH verursacht wurden, und auch nicht für Leistungsstörungen, die durch höhere Gewalt verursacht wurden.

8.2 Haftungsausschluss im Falle einer Insolvenz des Vertragspartners von Dimensione Europa GmbH

Für den Fall, dass ein Vertragspartner von Dimensione Europa GmbH, (Hotel, Restaurant, ecc.) aufgrund von Insolvenz gezwungen ist, seine Tätigkeit aufzugeben bzw. einzustellen und dadurch nicht mehr imstande ist, die bei ihm gebuchten Gäste zu den ursprünglich vereinbarten Konditionen - bei sich oder in einem anderen Haus - unterzubringen, ist Dimensione Europa GmbH selbstverständlich bemüht, Alternativen zu finden.

Dimensione Europa GmbH ist für diesen Fall jedoch nicht verpflichtet, die Gäste anderweitig unterzubringen, im Besonderen nicht zu selben Konditionen. Ferner übernimmt Dimensione Europa GmbH auch keine Haftung für allfällige Schadenersatzansprüche in diesem Zusammenhang.

Rechtswahl, Gerichtsstand und Erfüllungsort

Für Geschäfte mit der Firma Dimensione Europa GmbH in Rosenheim gilt ausschließlich das deutsche Recht. Als Erfüllungsort ist für diese Geschäfte Rosenheim und als Gerichtsstand das Amtsgericht Traunstein vereinbart.

Unwirksamkeit einer Klausel

Die Unwirksamkeit einer der vorstehenden Bedingungen berührt nicht die Wirksamkeit der restlichen Bedingungen.
